Divorce and family law disputes affect the children’s future, the financial balance and the parties’ everyday lives all at once. Alongside the legal strategy, communication must therefore also be handled with care.
Uncontested divorce
Where the parties agree on the divorce and its consequences, the process can be completed quickly on the basis of a comprehensive and workable protocol. Setting out custody, contact arrangements, maintenance, division of property and compensation clearly and completely in the protocol helps prevent new disputes from arising later.
Contested divorce
Where no agreement can be reached, divorce is sought through litigation, relying either on the general ground of the fundamental breakdown of the marriage or on the specific grounds listed in the law, such as adultery, attempt on life or desertion. Collecting and submitting evidence by lawful means is of great importance in this process.
Children and maintenance
Custody, contact and child support are determined on the basis of the best interests of the child. Interim maintenance may be claimed for the duration of the proceedings and, where the conditions are met, post-divorce spousal maintenance (yoksulluk nafakası) may be claimed for the period after the divorce.
Protective measures
Where there is violence or a risk of violence, an application can be made promptly for barring orders and similar protective measures under Law No. 6284 on the Protection of the Family and the Prevention of Violence against Women.
