Two elements determine the outcome of compensation cases: proof of the damage and of fault, and the correct calculation of the loss. It is therefore important to secure evidence immediately after the incident and to support it with expert reports.
Accidents
In traffic and workplace accidents, the apportionment of fault, medical expenses, incapacity for work and loss of earnings and, in the event of death, the loss of support are examined in detail. Compulsory insurance applications, the Insurance Arbitration Commission and court proceedings are considered together.
Medical malpractice
Liability arising from errors in diagnosis and treatment and from the absence of informed consent is assessed in light of medical records and expert examinations. Claims concerning public hospitals are brought before the administrative courts, and claims concerning private healthcare institutions before the civil courts.
Non-pecuniary damages
Claims for non-pecuniary damages in cases such as violation of personality rights, bodily harm or the loss of a close relative are prepared taking into account the specific circumstances of the case and case law.
