Frequently asked questions

Common questions about Employment Law

How long do I have to seek reinstatement?

An application to a mediator must be made within one month of service of the notice of termination. If no agreement is reached in mediation, a lawsuit may be filed before the labour court within two weeks of the date on which the final mediation report was drawn up.

Can I file a lawsuit directly for employee receivables?

No. For employee and employer receivables and compensation claims based on the law or on an individual or collective employment agreement, as well as for reinstatement claims, applying to a mediator before filing a lawsuit is a mandatory precondition (Article 3 of Labour Courts Law No. 7036).

What are the conditions for entitlement to severance pay?

As a rule, at least one year of service with the same employer is required, and the employment contract must end in one of the ways listed in the law; for example, termination by the employer without just cause or termination by the employee for just cause.
