Common questions about Enforcement and Bankruptcy Law

What is the time limit for objecting to a payment order?

In enforcement proceedings without a judgment by way of general attachment, an objection must be made within seven days of service of the payment order (Article 62 of the Enforcement and Bankruptcy Law, İİK); in proceedings based on negotiable instruments, it must be made within five days (Article 168 İİK).

What can the creditor do if the debtor objects?

Within one year of service of the objection, the creditor may file an action for annulment of the objection before the general courts (Article 67 İİK) or, if it holds the required documents, request the removal of the objection from the enforcement court within six months (Article 68 İİK).

What can I do against enforcement proceedings started for a debt I do not owe?

In addition to objecting to the payment order in time, a negative declaratory action can be filed to establish that no debt is owed; if the debt has been paid, an action for restitution can be filed within one year of payment (Article 72 İİK).
